An Illinois teenager accused of shooting and killing two protesters during demonstrations and unrest in Wisconsin was extradited to that state on Friday.
A judge accepted an extradition request to bring Kyle Rittenhouse, 17, living in Antioch in northern Illinois, to Wisconsin, and he arrived at the Kenosha County Detention Center later that day, according to officials and documents. of the court.
The judge denied attorney Rittenhouse’s argument that the documents were inconsistent with statutory requirements and that the extradition of the teenager to Wisconsin would violate his Constitutional rights.
Rittenhouse was charged with willful first-degree murder, first-degree reckless murder, willful first-degree murder and other crimes in the shootings that killed Joseph Rosenbaum and Anthony Huber, and wounded the man. Tuesday on August 25.
The shooting happened after Rittenhouse arrived in Kenosha during protests and turmoil following police shooting Jacob Blake, a Black man who was shot in the back on August 23. Blake survived, but his family let know he is paralyzed.
Rittenhouse̵7;s attorneys said Rittenhouse acted in self-defense and he was there to try to protect businesses.
At a hearing in Illinois on Friday, Rittenhouse’s lawyer, John Pierce, told Lake County Judge Paul Novak that he no longer wanted to call witnesses, and instead he focused on what he called. are “fatal defects” in extradition papers.
An Illinois prosecutor, Assistant State Counsel for Lake County, Stephen Scheller, countered that extradition laws were clear, The Associated Press reported.
“You can imagine chaos if someone could commit a crime and step across (state boundaries) and get to the sanctuary,” said Scheller.
Rittenhouse’s attorneys argued that there was not enough evidence that the petition was sworn to the required judge, the court order allowing states to extradite.
Novak wrote in order that Rittenhouse gave no evidence of that.
“Even if this court finds that the complaint is not brought before a judge as outlined above, Rittenhouse’s argument will still fail,” wrote the judge,
Novak noted that an affidavit of probable cause was also filed in response to the law, that the second judge found possible causes for Rittenhouse’s arrest and that a judge in Kenosha County. also determines that there is a probable cause that supports the arrest warrant and is in compliance with the law.
The Kenosha County Sheriff’s Department on Friday said Rittenhouse was in prison after being extradited.
Before the shootings of two protesters took place, there were many nights of demonstrations and demonstrations. There have been several looting and damage to businesses, including burned buildings.
Rittenhouse is armed with what the authorities describe as the Smith & Wesson .223-caliber AR-15 rifle.
However, that gun was purchased and stored in Wisconsin, Lake County prosecutors said, meaning Rittenhouse would not face the gun charges in Illinois. His attorneys said in a statement that Rittenhouse and a friend armed themselves that night and the gun never crossed state boundaries.
The shooting was recorded on video. The video appeared showing Rosenbaum throwing a plastic bag at Rittenhouse, which didn’t hit him and reaching Rittenhouse before he was shot, court documents said. A witness told police Rosenbaum was trying to get Rittenhouse’s gun.
Rittenhouse briefly ran away and heard people say “I just killed someone” on his cell phone, according to the criminal complaint.
The video also showed Rittenhouse being watched by people as he ran, he appeared to walk and then shot at another who jumped at him, who had not been hit by bullets, the lawsuit said. The video shows Huber approaching while carrying a skateboard and trying to pull the rifle out of Rittenhouse before he is shot dead. A third person, who appeared to have had a handgun, was later shot in the hand, according to the lawsuit.
“This is a classic defense, and we will prove it,” Rittenhouse’s lawyer, Pierce, said previously. “We will win justice for Kyle no matter how long the fight lasts.”
If convicted of first-degree murder, Rittenhouse faces a life sentence.
